1. Agreement to these terms
These Terms of Service (“Terms”) are a legal agreement between you and Happy Heart Games (“Happy Heart,” “we,” “us,” or “our”). They govern your use of happyheartgames.com and any game, application, or service that links to these Terms (together, the “Services”). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Who may use the Services
You must be legally able to enter into this agreement. If you are under the age of legal majority where you live, your parent or legal guardian must review and accept these Terms for you. Some Services may have additional age requirements. You may not use the Services if applicable law prohibits it.
3. License to play
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your own non-commercial entertainment. Happy Heart and its licensors retain all rights in the Services, including all code, artwork, characters, stories, music, names, logos, and other content.
4. Accounts and security
Some Services may allow or require an account. You agree to provide accurate information, keep your login details confidential, and promptly tell us about unauthorized access. You are responsible for activity on your account to the extent permitted by law. We may reject, reclaim, or require changes to usernames that are misleading, offensive, or infringe rights.
5. Fair-play rules
You agree not to:
- harass, threaten, impersonate, or harm another person;
- cheat or use bots, automation, exploits, unauthorized mods, or other tools that alter gameplay or give an unfair advantage;
- reverse engineer, copy, scrape, disrupt, or overload the Services except where law expressly permits it;
- access another person’s account or collect information about other players without permission;
- use the Services for unlawful, commercial, or fraudulent purposes, or infringe another person’s rights;
- bypass security, access controls, or technical limits.
6. Purchases and virtual items
A Service may offer paid content, subscriptions, or virtual items. Prices and terms are shown before purchase. Transactions may be handled by an app store or payment provider and are also subject to its terms. Except where law requires otherwise, purchases are final and non-refundable.
Virtual items have no real-world monetary value, are licensed rather than sold, and cannot be redeemed for cash or transferred outside the Service unless we expressly allow it. We may change or discontinue virtual items where reasonably necessary, subject to applicable law.
7. Player content
If a Service lets you submit text, images, names, or other content, you keep your ownership rights. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, and distribute that content only as needed to operate, improve, promote, and protect the Services. You must have the rights needed to submit it. We may remove content that violates these Terms or may harm the Services or others.
8. Updates and availability
We may update, balance, add, or remove features and content. We may suspend or discontinue all or part of a Service, including for maintenance, security, legal, or business reasons. We will provide notice when reasonably practical and required by law. The Services may not always be available or error-free.
9. Third-party services
The Services may link to or integrate third-party platforms, stores, websites, or services. Their terms and privacy practices apply to their services. We are not responsible for third-party services we do not control.
10. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
11. Limitation of liability
To the fullest extent permitted by law, Happy Heart and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Services. Our total liability for claims relating to the Services will not exceed the greater of the amount you paid us for the relevant Service during the six months before the claim or US$50. These limits do not apply where prohibited by law.
12. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, or where necessary to protect the Services or others. Where appropriate, we will give notice and a chance to appeal. Provisions that by their nature should survive termination will survive.
13. Governing law
These Terms are governed by the laws applicable where Happy Heart Games is established, without regard to conflict-of-law rules. Any mandatory consumer protections and rights to bring a claim in your home courts remain unaffected. We encourage you to contact us first so we can try to resolve any concern informally.
14. Changes to these Terms
We may update these Terms to reflect changes to the Services, law, or our practices. We will post the updated Terms and revise the “Last updated” date. If a change is material, we will provide additional notice where required. Continued use after the effective date means you accept the updated Terms.
15. General terms
These Terms and incorporated policies are the entire agreement about the Services. If a provision is unenforceable, the rest remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a business transfer. Headings are for convenience only.
